PROMOTION PROCESSES FROM ONE SCALE TO ANOTHER – TREATMENT FOR NON-REPORTING OF PROMOTEES AT THE PLACE OF POSTING ON THE PRESCRIBED DATES

1.
If the promotee  officer does not submit in writing about his/her inability to accept the promotion before the common date of reporting as prescribed by the Central Office.


It should be constructed that he/she has accepted the promotion and the member should be relived from the branch to report at the advised place of posting on promotion. Oral requests from the concerned officers for not to relieve them, should not be accepted.

Once the officer got relieved from the earlier branch/office to report at the place of posting (ie., at the controlling office to which he/she was allotted), he/she should not be allowed to report back to the branch/office  from which he/she got relieved, on any ground/reason whatsoever  including on the premise of he/she is not willing to take up the promotion, as it tantamounts  to reversion, which is not allowed as per the existing provisions of the Promotion Policy for Officers (Mainstream & Specialist Category Officers).   This is so because,  having accepted the promotion and got relieved from the existing branch/office, he/she deemed to have accepted the promotion and as such he/she  should have to report at the place of posting on promotion.

Further, once the promotee officer repots at the place of posting (ie., at the controlling office  to which he/she was allotted),  he/she  deemed to have accepted the promotion and thereafter he/she cannot seek reversion to pre-promoted scale, in terms of the existing provisions of the Promotion Policy for Officers (Mainstream & Specialist category Officers).

If the promotee officer submits in writing about his/her inability to accept the promotion before the common date of reporting as prescribed  by the Central Office.



It should be constructed that he/she has refused the promotion and the member should not be relived from the branch. Consequently, by implication of his/her refusal to accept the promotion, his/her promotion stands annulled automatically and he/she stands debarred for participating in future promotion processes for such time period as stipulated in the relevant Promotion Policy, at the relevant point of time.  Hence, no representation of any kind in respect of the promotion which stands annulled should be entertained and forwarded to Central Office.  It is further clarified that any such representation received at Central Office either through the concerned officer and/or outside sources, will not be given cognizance. Further, such officers who bring pressures on the management through outside agencies on such matters will be dealt with severely interms of the existing guidelines/instructions. 

Although the above provisions are clear and unambiguous, for the ready reference, the member should be served an intimation immediately on the same day informing  that on account of his/her refusal to accept the promotion which was offered, his/her promotion stands annulled and he/she stands  debarred for participating in the next promotion process for the period as stipulated in the Promotion Policy, at the relevant point of time.   The responsibility of conveying this shall rest on the concerned Branch Manager (if he/she is working in branches) or the head of HR (in case he/she is working in administrative office).

It is however, clarified that since the implied provisions on the consequences of refusal of promotion are already in place in the relevant Policy documents which are widely circulated among all employees, not issuing such a communication on the consequences of refusal of promotion for any reason what-so-ever, does not entail him/her to claim that such annulment of promotion and/or debarment for further promotion, do not apply to them.

If the promotee officer wants extension of time for reporting,  he/she should seek and obtain such extension from the Competent Authority ie., Central Office,  well before the common date of reporting. 

In such case, the relieving of the promotee officer be deferred to such date and no representation for change of place of posting be entertained from the member and/or forwarded to Central Office.  If such representation received at Central Office, it will not be given any cognizance.

4.
If the member submits a representation for extension of time for reporting at the place of posting on the common date prescribed by Central Office and no response is received from Central Office before the date of reporting on promotion.
This should be construed that the management has not found favour of such request.  Accordingly, he/she should be relived from the branch/office to report at the place of posting on promotion, unless he/she gives a letter of refusal before the date of relieving, irrespective of his/her representation for which no response was received from Central Office.    In other words, such promotee officers should not be detained at the branch/office without relieving, on the premise of no response received from Central Office for their representation.

In such cases also the procedure as stated in point No.2 should be followed.
5. 
If the member submits a representation for change of placement/posting before the common date of reporting in the promoted scale as prescribed by Central Office.

Such representations should not be entertained and if such representations receive at Central Office either directly and/or through proper channel/outside sources etc., no cognizance will be given.  Consequently, he/she should be relieved from the branch/office to report at the place of posting on promotion, unless he/she gives a letter of refusal before the date of relieving, irrespective of the fact that no response has been received from Central Office to his/her representation. In other words, such promotee officers should not be detained at the branch/office without relieving on promotion, on the premise of no response was received from Central Office for their representation, before the date of relieving.  

In such cases also the procedure as stated in point No.2 should be followed.

6.
If the member refuses the promotion and submits a representation any time after  the common date of reporting in the promoted scale  as prescribed by Central Office, requesting the management  to allow him/her to report at the place of posting.

Once a promotee officer does not report at the advised place of posting (ie., at the controlling office to which he/she was allotted) on the common date of reporting prescribed by Central Office for whatever reasons (except where the extension was granted by Central Office and received by the member before the stipulated date of reporting), he/she  is deemed to have refused the promotion and the promotion stands annulled and he/she shall be debarred for next promotion as per the provisions of the policy. Hence, the question of granting promotion which was annulled, will not arise.  Accordingly, such representations will not be given any cognizance.

As stated to point (2) above,  which such officers shall also be given an intimation on the consequences of refusal of promotion, it should be noted that, not issuing a debarment letter on the consequences of refusal of promotion for any reason what-so-ever, does not entail him/her to claim that such annulment of promotion and/or debarment for further promotion, do not apply to them.
